Joseph Ott is a trial lawyer at Burger Law.
Joseph Ott graduated from the University of Missouri School of Law, where he was a founding member of the Law Students for Public Media. While in law school, Joseph assisted in the development of a leading casebook on the First Amendment. Joseph was also a presenting lecturer in the 2012 Graduate and Professional Student’s Symposium at the University of Missouri for his research on Wikileaks and the First Amendment. He was a moot court semi finalist his 1L and 2L years.
Prior to attending law school, Joseph grew up in the St. Louis area where he attended De Smet Jesuit High School. At De Smet, Joseph competed at the state and regional level in tennis competitions in addition to winning numerous competitions for his photography. He attended Regis University in Denver where he received a dual conferment of a BS in economics and a BA in philosophy.
Joseph is licensed to practice in Missouri and is a member of the Missouri Trial Lawyers Association. He is an active member of the Missouri Zen Center.

When you are injured on the job, sometimes the injury itself can be the least of your worries. 1. Provide notice to the employer. Under the statute, this notice must occur immediately after the injury has occurred. Your claim can be weakened if you do not tell the employer right away, although the St. Louis area workers’ compensation attorneys at Burger Law can still work with you if you did not. Tell the employer to fill out a written report of this notice. They have to do this, even if they do not believe you.When providing notice to the employer, make sure to record the name of the supervisors who you reported the injury to. Also, write down the names of any witnesses and their phone numbers or other contact information. 2. Get medical treatment for your injury. Missouri law requires the employer to provide you with medical treatment, but there is a catch – the employer must first authorize the doctor to provide treatment. Make sure to report all aches and pains to the doctor, because sometimes the doctors who the employer has chosen will under prescribe treatment. There are many types of injuries sustained at work, but a common denominator of all workplace injuries is the difficulty to fully treat and recover while performing the same duties. Often, after an injury is treated, the employee returns to the same job responsibilities and is at even greater risk of re-injuring themselves as they repeat the actions that caused harm originally. Back and Neck Injuries
Trauma to your spine is life changing. Back and neck injuries are some of the more common issues we handle with workers’ comp claims. Your neck (also referred to as your cervical spine) and back are susceptible to injury from heavy lifting, slips and falls, repetitive movement, car accidents or other occupational hazards. Am I Entitled to Temporary Total Disability?
Typically, the process to receive Temporary Total Disability (TTD) takes 45 days before a judge can rule on the case. During this time, it may be difficult to meet financial responsibilities and care for your family. We can help you fight this unfair insurance practice and secure weekly benefits.
However, you should be aware of several reasons an employer may stop paying TTD:
1. Surgery for an occupational injury. If your employer pays for your medical intervention to remedy an on-the-job injury, they are no longer liable to pay you TTD while you recover from the procedure.
2. Termination for a reason unrelated to your workers’ comp claim. It is illegal to fire you as retaliation for filing a workers’ comp claim, but if you are terminated for other reasons (i.e. tardiness, poor job performance) then your employer can stop paying TTD.
3.Application for unemployment. If you are receiving TTD from your employer you should not apply for unemployment—that violates legal and ethical standards. Claiming unemployment benefits indicates you are able to work while receiving TTD support conveys you are injured and cannot perform your work duties.

Consumer Protection
The Missouri Merchandising Practices Act (MMPA), R.S.Mo. 407.010 et seq., prohibits unlawful, unfair or deceptive practices. It only applies to purchases or leases of goods or services, primarily for personal, family or household purposes. This includes outright fraud, as well as other anti-consumer behavior like overbearing or improper conduct, lying, bait and switch, false advertising, exaggerating or stealing. While fraud requires proof of intent to deceive, the MMPA does not. Therefore, regardless of what the violator was thinking, if they committed an unfair or deceptive act, they violated the MMPA. Under the MMPA, the court can order the violator to pay the consumer’s attorney’s fees.
Gary Burger and Burger Law have used the MMPA in these examples:
- Gary represented a woman who had her property taken when it was stored at a local U-Haul storage facility. Gary sued U-Haul for taking the property and because the defendant was deceptive in not disclosing the identity of the person who had her property.
- Gary represented a student who was kicked out of her college in clear violation of her enrollment agreement. The school claimed that the student violated the school’s attendance policy, but the student had evidence to the contrary. Gary sued and used the MMPA to claim that the school employed an unfair practice in the lawsuit.
- Gary represented a group of consumers against a local St. Louis dealership. The dealership sold a “Protector Armor Package” treatment to consumers who purchased a new cars from the dealership. The consumers later discovered that though they paid for Protector Armor Package, their cars were never actually treated.

Her injuries were severe and her medical was high. She suffered some fractured ribs, lacerated spleen injuries to other internal organs. She had to undergo surgery and was left with approximately $60,000 in medical bills. The defendant strongly contended that she should not have been driving the motorcycle and caused the accident by her own negligence. However, the jury did not believe this defense and agreed with our position (and the real facts) that the defendant had crossed the center line and had caused the accident. The jury returned a verdict for $500,000 apportioning 5% fault on the Plaintiff and 95% on the Defendant resulting in a verdict of $475,000.

Carbon monoxide (CO) is a colorless, odorless, poisonous and deadly gas. It is produced by the incomplete burning of various fuels, including gasoline, propane, natural gas, coal, wood, oil and kerosene. Dangerously, it is produced by home heating units (and portable generators, cars, lawn mowers). Home heating is not supposed to kill occupants – when it does usually the furnace manufacturer, repairman and/or gas company has done something terribly wrong. Early and quick investigation is crucial to proving these cases. Dangerous Gas
People may not know that they are being exposed because CO is odorless, colorless and otherwise undetectable to the human senses. The initial symptoms of low to moderate CO poisoning are similar to the flu (but without the fever). They include:
- Headache
- Fatigue
- Shortness of Breath
- Nausea
- Dizziness
High-level CO poisoning results in progressively more severe symptoms, including:
- Mental Confusion
- Vomiting
- Loss of muscular coordination
- Loss of consciousness
- Ultimately death
Symptom severity is related to both the CO level and the length of time you are exposed. For slowly developing residential CO problems, occupants and/or physicians can mistake mild to moderate CO poisoning symptoms for the flu, which sometimes results in tragic deaths. For rapidly developing, high-level CO exposures (e.g., associated with use of generators in residential spaces), victims can rapidly become mentally confused and can lose muscle control without having first experienced milder symptoms; they will likely die if not rescued.
Stats
On average, about 170 people in the United States die every year from CO produced by non-automotive consumer products. These products include malfunctioning fuel-burning appliances, such as furnaces, ranges, water heaters and room heaters; engine-powered equipment, such as portable generators; fireplaces and charcoal that is burned in homes and other enclosed areas.
In 2005 alone, at least 94 generator-related CO poisoning deaths occurred. Forty-seven of these deaths were known to have occurred during power outages due to severe weather, including Hurricane Katrina. Still, others die from CO produced by non-consumer products, such as cars left running in attached garages. The Center for Disease Control and Prevention estimates that several thousand people go to hospital emergency rooms every year to be treated for CO poisoning.

Below are a few suggestions that Burger Law offers as helpful tips to try and stay on top of Carbon Monoxide prevention:
- Make sure that appliances are installed and operated according to the manufacturer’s instructions and local building codes. Most appliances should be installed by qualified professionals. Have the heating system professionally inspected and serviced annually to ensure proper operation. The inspector should also check chimneys and flues for blockages, corrosion, partial and complete disconnections and loose connections.
- Never service fuel-burning appliances without proper knowledge, skill and tools. Always refer to the owner’s manual when performing minor adjustments or servicing fuel-burning equipment.
- Never operate a portable generator or any other gasoline engine-powered tool either in or near an enclosed space such as a garage, house or other building. Even with open doors and windows, these spaces can trap CO and allow it to quickly build to lethal levels.
- Install a CO alarm that meets the requirements of the current UL 2034 safety standard. A CO alarm can provide some added protection, but it is no substitute for proper use and upkeep of appliances that can produce CO. Install a CO alarm in the hallway near every separate sleeping area of the home.
- Make sure the alarm cannot be covered up by furniture or draperies.
- Never burn charcoal inside a home, garage, vehicle or tent.
- Never leave a car running in an attached garage, even with the garage door open.
- Never use gas appliances such as ranges, ovens or clothes dryers to heat your home.
- Never operate unvented fuel-burning appliances in any room where people are sleeping.
- Do not cover the bottom of natural gas or propane ovens with aluminum foil. Doing so blocks the combustion air flow...

Missouri wage and hour attorney, Gary Burger pursues employers who do not fairly compensate their employees for work. In Missouri, wage laws are governed by the Fair Labor Standards Act (FLSA) and the Missouri Wage and Hour laws. These laws cover minimum wage, overtime pay, classification of employees as exempt or non-exempt and a number of other key issues. Employees are entitled to compensation for their hours worked and should be paid at least twice a month, with some exceptions. The way an employee is paid will depend on whether he/she is classified as exempt (salaried and therefore not entitled to overtime pay) or non-exempt (hourly and therefore entitled to overtime pay for time worked more than 40 hours in a week).
If you are a covered employee, an employer must compensate you for:
- All the time you perform doing work for the benefit of the employer (limited exceptions apply).
- Any work that, though not requested by your employer, is permitted by your employer.
- Any work over 40 hours per week at time and a half (overtime pay).
Some employers have job requirements that force employees to perform job-related tasks “off the clock.” That means that an employee might have to perform work or work-related activities before their official work shift starts and after their official work shift ends. These additional uncompensated activities can add up to a lot of unpaid wages. Furthermore, if an employee already works a 40 hour work week, this uncompensated work could mean that the employer is liable for over-time pay.
These situations often come up when an employer has specific requirements that an employee has to fulfill before starting work, and the employer does not pay its employees for fulfilling those requirements. If your employer requires that you put on a specific uniform, gear or equipment before starting work, and does not pay you for the time it takes, you might have a wage and hour claim.
Gary Burger is currently representing Missouri Department of Corrections Officers in a class action lawsuit against the State of Missouri for unpaid work time and over-time. The State of Missouri pays its Corrections Officers for a 40-hour work week made up of work shifts. The Corrections Officers are expected to be at their posts at the beginning of their shifts and remain there until the end of their shift. Careful practitioners are familiar with a number of maneuvers and techniques to successfully deliver the child at that time (suction, forceps, maneuvering the shoulders). The standard of care is to safely deliver the shoulders without injury. If a doctor forces the delivery, pulls too hard on the head or neck, does not free the shoulder, does not use adequate suction, the doctor or nurse can stretch and damage the baby’s nerves. An affected child can lose the use of her arm.
